Land Oberosterreich v Commission. GM Crops

The European Court of Justice (ECJ) gave its judgement in the case of Land Oberösterreich v Commission (Case T-366/03) on 5 October 2005. The case concerned an application by the Republic of Austria for annulment of Commission Decision 2003/653/EC of 2 September 2003 relating to national provisions on banning the use of genetically modified organisms in the region of Upper Austria.

Meanwhile, in another European case concerning both the Birds Directive (Directive 79/409/EEC) and the Habitats Directive (Directive 94/43/EC), the Advocate General has delivered her opinion.

The ECJ delivered its judgement in the case of Commission v Greece (Case C-502/03) on 6 October 2005.

The European Court of Justice (ECJ) gave judgement this month in the case of European Commission v Hellenic Republic (Case C-166/04).

The European Commission has given its judgement in the case of Commission v UK (Case C-6/04).

UK v Commission. Emissions Trading

Following the Commission's rejection of the UK's proposed amendment to the total quantity of allowances in the UK's National Allocation Plan (NAP) for Phase 1 (2005-2007) of the EU ETS, the UK's legal challenge against the European Commission was heard by the European Court of First Instance on the 18 October 2005 further to proceedings having been initiated in March of last year.

Meanwhile, in a case which came before the High Court this month, Greenpeace have failed in their attempts to ensure that stronger measures are taken by Government in order to protect dolphins from trawling in the English Channel.
